Services We’re Offering

To help you and your sellers prepare, we’re excited to announce the launch of a dedicated online portal for creating Disclosure Statements. This portal will go live on 1 August 2025, and we’ll provide you with a link to share with your sellers as soon as it's available.

Our pricing for preparing Disclosure Statements on behalf of sellers is a fixed fee of $330.00 (plus applicable search fees). The cost of searches will depend on the information your seller can supply. A detailed list of potential search fees will be available via the portal link.

Bonus Offer: When a seller engages us to prepare their Disclosure Statement, they’ll receive a $110 discount on our conveyancing fees.

The Form 2 Disclosure Statement can be prepared anytime after the Form 6 Appointment is signed. It must be given to buyers before they sign the contract. Preparing this early allows your sellers to move smoothly and quickly through contract negotiation and execution.

Forms

The Form 2 Disclosure is now available on Realworks, so you can review it at your convenience. However, keep in mind that:

  • It only needs to be signed and provided for contracts dated 1 August 2025 or later.

  • Contracts signed before this date do not require the Form 2 Disclosure.

Contract Changes – Effective 1 August 2025

To align with the new disclosure requirements, a revised REIQ Contract of Sale will also be released on 1 August 2025.

While it’s not mandatory to use the new contract version immediately, it’s strongly recommended. Contracts signed after 1 August using the previous version will still be legally binding, but using the updated version ensures you benefit from the latest improvements.

Key Changes in the New Contract:

  1. One contract form for all residential land, house, and unit sales.

  2. New sections and questions regarding GST liability and Land Tax liability.

  3. Additional clauses about the Seller Disclosure Statement.

The layout of the contract has also been reformatted, so it may look unfamiliar at first.

The sections related to GST and Land Tax are likely to raise the most questions. We’re happy to provide further clarification where needed, and we always recommend your sellers seek independent legal or financial advice regarding these clauses.

Changes for Lots in a Community Title Scheme

From 1 August 2025, the Form 206 Disclosure Statement will no longer be required when selling a lot in a Community Title Scheme.

Instead, the new Form 2 Disclosure Statement will incorporate a Body Corporate Information Certificate—either a Form 33 or Form 34, depending on the type of scheme. These certificates will be provided by the Body Corporate Manager/Secretary and attached to the Form 2 Disclosure Statement (which are provided to the Buyer prior to signing the contract).
